These Terms and Conditions ("Terms") govern your use of the website located at www.prescottasphaltpaving.com and any services provided by Prescott Asphalt Paving ("Company," "we," "us," or "our"). By accessing our website or requesting services, you agree to these Terms. If you do not agree, please do not use our website or services.
By using our website or engaging our services, you confirm that you are at least 18 years old and have the legal authority to enter into a binding agreement. If you are acting on behalf of a business or property owner, you represent that you have the authority to bind that party to these Terms.
Prescott Asphalt Paving provides asphalt paving, sealcoating, crack sealing, pothole repair, parking lot services, concrete curbing and sidewalks, grading, drainage, and related exterior paving services in and around Prescott, Arizona.
Our website provides general information about our services and allows visitors to submit estimate requests. Submitting a request does not create a contract or guarantee that services will be provided. A binding agreement for services is formed only when both parties have signed a written estimate or contract.
All estimates provided by Prescott Asphalt Paving are based on the information available at the time of the site visit or inquiry. Estimates are valid for the period specified in writing. If site conditions, scope of work, or material costs change before the work begins, the estimate may be revised.
Written estimates include a description of the work to be performed, materials to be used, and total price. Verbal estimates are not binding. Any changes to the agreed scope of work must be approved in writing by both parties before additional work proceeds.
Prices do not include permit fees, utility locating charges, or costs arising from unforeseen site conditions (such as buried obstructions, unstable subgrade, or access restrictions) unless specifically stated in the written estimate.
Once a date is confirmed, we ask that you notify us as soon as possible if you need to reschedule. We reserve the right to reschedule work due to weather conditions, material availability, or other circumstances outside our control. We will notify you promptly and work with you to find the earliest available alternate date.
If a customer cancels a confirmed project after materials have been ordered or mobilization has begun, the customer may be responsible for costs reasonably incurred by Prescott Asphalt Paving up to that point. These terms will be specified in the written contract for each project.
Payment terms for each project are stated in the written contract. In general, a deposit may be required before work begins, with the remaining balance due upon completion. Final payment is due at project completion unless other terms are specified in writing.
Late payments may be subject to a finance charge as permitted under Arizona law. Prescott Asphalt Paving reserves the right to suspend or withhold services if payment obligations are not met. In the event of non-payment, the customer agrees to reimburse Prescott Asphalt Paving for reasonable costs of collection, including attorney fees, as allowed by law.
Before work begins, the customer is responsible for:
Prescott Asphalt Paving warrants that work will be performed in a professional and workmanlike manner in accordance with the specifications in the written contract. Any warranty on workmanship will be stated in the individual project contract. No warranty is provided beyond what is expressly stated in that contract.
Natural deterioration of asphalt or concrete surfaces over time, damage caused by customer misuse, acts of nature (including freeze-thaw cycles, flooding, or extreme weather), or failure to follow maintenance recommendations do not constitute defects covered under any workmanship warranty.
THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the fullest extent permitted by Arizona law, Prescott Asphalt Paving and its employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or the performance of our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from services rendered shall not exceed the amount paid by the customer for the specific project giving rise to the claim. Some jurisdictions do not allow certain limitations of liability - in those cases, our liability is limited to the greatest extent permitted by law.
All content on this website - including text, images, logos, and design - is the property of Prescott Asphalt Paving or its content providers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any site content without our prior written consent.
If a dispute arises between you and Prescott Asphalt Paving related to our services or these Terms, we encourage you to contact us directly first. Most concerns can be resolved quickly through a direct conversation.
If the dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any unresolved disputes shall be resolved through binding arbitration or in a court of competent jurisdiction in Arizona, as agreed upon by the parties in the written service contract.
These Terms and any disputes arising from them are governed by the laws of the State of Arizona, without regard to its conflict-of-law provisions. Any legal proceedings related to these Terms shall be brought in the appropriate courts of Arizona.
We may update these Terms at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the website after changes are posted means you accept the updated Terms. If changes materially affect an existing service agreement, we will notify you directly.
